What Are Scottsdale’s Divorce Laws?
Part of getting a divorce in Arizona is navigating the state’s unique divorce laws. This is something that an experienced attorney from Guymon Law can help you with. First, know that Arizona is a no-fault divorce state. This means you do not have to prove that your spouse is at fault for the breakdown of your marriage. Instead, you can simply cite irreconcilable differences or that you believe your marriage is irretrievably broken.
Second, Arizona is in the minority of states as one that uses a community property law for property division. With a community property law, a judge will divide a couple’s community property in half – 50/50 – in a divorce case, whether or not this is fair for either party. Community property refers to any assets (and debts) acquired during the course of a marriage. In an equitable division state, on the other hand, a judge will divide assets based on what is fair, or equitable, for each spouse.
Like all states, Arizona allows a couple to work out a settlement agreement before it will intervene.
